Investment Laws
On the investment laws, we look at the local particular laws made by a specific country(DRCongo) and the international instruments ratified by the Congolese government and domesticated by local laws passed by the parliament. We consider the need of investors and guide them with the respect of both international and local instruments so that we get to assist our clients in a better way.
Mineral Laws
On the mining/mineral laws, we first of all consider the international laws on the mineral activities as required by the Dualism which is the mode of ratification applicable for the DRC as a procedure of treaties ratification which is that all international treaties ratified by the Congolese government should be applied as the first one in consideration of the hierarchy of the sources of the law... see more In only one condition the international treaty to be domesticated by local laws through the parliament. For sure, Congo as a country and the entire judiciary organ have also organised a certain numbers of laws which lawfully organize the minerals and mining activities within the Country.
These departments are coordinated and managed by Mr. MUSENGA TSHIMANKINDA CHRISTIAN who is well composed and knowledgeable with a deeper experience in both fields. He works at local and international level across Africa, Asia, Europe and America with a strong and well established network of investors and buyers who are interested to work in DRCongo. As the firm intervenes also on sport activities, Mr MUSENGA TSHIMANKINDA CHRISTIAN also coordinates that department in the law firm as he has a broad knowledge on that field with a particularity expertise on Football laws and regulations. On the mining/minerals/mines laws, he has a deeper expertise and experience with the local legal system and internationally knowledge as well. He advises from individuals, private companies to public institutions and international companies/institutions/organisations on mining activities.
The law firm also works on refugee issues within Africa and across the world. We do ensure that refugees access their rights starting from their livelihoods(education and economic activities) to legal protection. On their livelihoods, the firm makes sure that refugees are enrole to schools from pre-unit, primary and secondary schools as well as professional trainings and universities to enable them to know how to read, write, develop skills, getting a job and/or starting their own commercial activities. About legal protection, the firm assists refugees in primarily acquiring documents as human rights start from there, and no exception allows on this principle. Once with documents, the firm ensures that refugees accessing services and goods that are vital for their lives either through advice, awareness and representation with our own or in conjunction with organisations/institutions which protect refugee rights. We defend refugee rights at all levels anytime and any place where refugee rights are violated.
